This policy explains what information Peak Evergreen LLC ("Peak Evergreen," "we," "us") collects through peakevergreen.com, how we use it, and the choices you have. We keep it short because we collect very little.

What we collect
Information you give us. When you use our contact form, we collect:
- Your name and email address
- Company name and phone number (optional)
- The subject and message you write
- Whether you checked the box to receive occasional product and project updates
Chat assistant. If you use the AI chat assistant on the site, we collect:
- Everything you type into the chat, and the assistant's replies (the "transcript")
- Any contact or project details you share during the chat, such as your name, email, company, goals, budget or timeline
- Technical details about the session, such as its time, the page you started from, and a session identifier
Information collected automatically. When you visit the site, we use PostHog, a product analytics tool, to understand how the site is used. It may record:
- Pages you visit, links and buttons you click, and how you move through the site
- The page that referred you, and campaign tags in the link (for example,
utm_source) - Your browser, device type, operating system, and approximate location based on your IP address
- A random identifier stored in a cookie or your browser's local storage, so return visits can be recognised
PostHog may also record replays of how pages are used, such as scrolling, clicks and page changes. Text you type into form fields and the chat assistant is masked and is not captured in these replays.
We also use Sentry to catch technical errors. When something breaks, it records technical details such as your browser, the page, and the error message.
We run our own PostHog and Sentry servers (posthog.peakevergreen.com and sentry.peakevergreen.com) instead of sending this data to third-party analytics companies.
We do not collect payment information through this website.
How we use it
- To reply to your message and discuss your project
- To run the chat assistant: generating replies, summarising your conversation into a project brief, and passing it to Kevin so he can follow up
- To send occasional product and project updates, only if you opted in
- To understand which pages are useful, fix problems, and improve the site
- To keep the site secure and prevent spam or abuse
- To meet legal obligations
We do not sell your personal information. We do not share it for cross-context behavioural advertising, and we do not use it to build advertising profiles.
Who we share it with
We share information only with service providers that help us run the business, and only as needed for that purpose:
- Hosting: the site, our analytics and error-monitoring servers, our CRM, and chat transcripts are hosted with DigitalOcean.
- Email delivery: a transactional email service delivers contact form notifications, replies and, if you opted in, update emails.
- Customer records: inquiries are stored in our own CRM system, which we operate ourselves and do not share with a third-party CRM provider.
- AI model provider: a third-party AI model provider processes chat messages to generate the assistant's replies. We use it under business or API terms that do not allow it to use our data to train its models. It may keep messages for a limited period for safety and abuse monitoring, as set out in its terms.
We may also disclose information if the law requires it, to protect our rights or safety, or as part of a sale or reorganisation of the business.
The chat assistant
- You're talking to an AI, not a person. The assistant is automated. Kevin reviews conversations that lead to a project inquiry and may read other transcripts to improve the service.
- Please don't share sensitive information in the chat. Examples include passwords, payment or bank details, government ID numbers, and health information. If you do share it, we'll delete it when we notice it.
- How transcripts are stored. Transcripts are stored on our own servers. We may review them to improve the assistant's instructions, but we do not use them to train any AI model.
- Deleting your chat. You can ask us to delete your chat at any time. See "Your rights" below.
Email updates
If you opt in to updates, we'll occasionally email you about new services, projects and articles. Every email includes an unsubscribe link, and you can also reply "unsubscribe" or email us. Chatting with the assistant or sending us a message does not sign you up. We won't send marketing texts or calls to the phone number you provide unless you separately agree to them.
Cookies and your choices
When you first visit, a banner asks whether you accept analytics cookies.
- If you accept, PostHog sets a first-party cookie and uses local storage to recognise return visits. It also records the session replays described above.
- If you reject, or haven't chosen yet, we don't set analytics cookies and don't record session replays.
Some storage is strictly necessary for the site to work, such as remembering your cookie choice and keeping your chat conversation open while you browse. It doesn't need consent.
You can change your choice at any time using the "Cookie settings" link in the footer. Turning on your browser's Global Privacy Control or Do Not Track setting counts as a rejection. You can also block or delete cookies in your browser settings. The site will still work either way.
Legal bases for processing (EEA and UK visitors)
If you're in the European Economic Area or the United Kingdom, data protection law requires us to explain the legal basis for each way we use your personal information:

International transfers. Peak Evergreen is based in the United States, so your information is processed in the US. Where we use service providers to process data from the EEA or UK, we rely on appropriate safeguards, such as the EU–US Data Privacy Framework or Standard Contractual Clauses.
Your additional rights. You can also object to processing based on legitimate interests, ask us to restrict processing, and ask for a copy of your data in a portable format. You have the right to complain to your local data protection authority, though we'd appreciate the chance to resolve your concern first.
How long we keep it
- Contact form messages and project inquiries: as long as needed to respond and for our business records, and generally no longer than 3 years after our last contact
- Chat transcripts: 90 days if no inquiry results. If the chat turns into a project inquiry, it's kept with our records for that inquiry, as above.
- Analytics data: up to 12 months
- Error reports: up to 90 days
- Email list: until you unsubscribe
Your rights
You can ask us to:
- Tell you what personal information we hold about you
- Correct it
- Delete it, including chat transcripts
- Stop sending you marketing emails
Email kevin@…. We'll respond within 30 days. Depending on where you live (for example, California, or the EU or UK), you may have additional rights under local law. We will honour them where they apply.
Security
We use reasonable technical and organisational measures to protect your information, including encrypted connections (HTTPS) and running our own analytics, error-monitoring and CRM infrastructure. No method of transmission or storage is completely secure.
Children
This site is not directed at children under 13, and we do not knowingly collect their information. If you believe a child has contacted us, email us and we'll delete it.
Changes
If we update this policy, we'll change the "Last updated" date above. If the changes are significant, we'll make that clear on the site.
